Councillors defer to VCAT

TWO Mitchell Shire councillors facing a Councillor Conduct Panel this week have requested to refer the matter to the Victorian Civil and Administrative Tribunal.
The North Central Review last week reported that allegations of bullying, abuse and council meeting misconduct had put Central Ward Cr Ross Lee and North Ward Cr Robert Parker at the centre of a council investigation.
It is believed that up to 10 claims of misconduct were to be investigated.
Crs Lee and Parker said they chose to take the issue to VCAT as they do not accept that due process has been adhered to by the Councillor Conduct Panel.
They provided The North Central Review with a short statement about their decision.
“VCAT is an independent, properly constituted appeals tribunal which complies with the rules of natural justice as heavily stressed last year by the High Court of Australia,” they said.
“VCAT has a proven track record of judicial probity, it is an open tribunal and the real story of why we have been targeted will be revealed.
“At present, based upon legal advice, we cannot say any more at this time.”
Mitchell Shire Council Chief Executive Officer David Keenan said he did not wish to comment on the Councillor Conduct Panel.
He said council was seeking information about a leak to the media about the issue.
“Mitchell Shire Council is disappointed that confidential information has been provided to the media and an internal investigation will be undertaken to seek to identify the source,” he said.
WKBG hits back
The Wallan Kilmore Bypass Group has denied claims that Cr Lee had used his council email to leak confidential council documents to the group.
WKBG president Brian Mawhinney said the group believed the allegation was a part of a campaign to discredit the WKBG.
“There are no names, no faces and yet they are making these allegations. There’s no proof,” he said.
“Never have we received any confidential emails from these councillors.
“I put a challenge to this ‘council insider’ to come to my house and search my computer personally at any time they wish.
“If they can’t do that then I think we are looking at a court issue.”
WKBG member Wendy Law said there “no doubt a campaign to get rid of the WKBG.”
“Someone is trying to scuttle the bypass,” Ms Law said.
“We’re very grateful for the public support that Cr Lee and Cr Parker have given us. “They are the only two councillors who have got behind the WKBG.
“What council information could they possibly be showing us that would be of any use to the WKBG?”
The WKBG said they are currently seeking legal advice.
Both Ms Law and Mr Mawhinney said they have provided Cr Lee and Cr Parker with a witness statement for the VCAT hearing.
A date for the hearing is yet to be confirmed.
