FORMER Mitchell Shire councillor Mike Hammond is taking legal action against the shire over personal health issues and claims that the shire failed to heed his advice about fuel reduction.
Mr Hammond attended a directional hearing at the Victorian Civil and Administrative Tribunal (VCAT) yesterday morning.
Mr Hammond said he had been told there was a “conspiracy” to have him thrown out of office during his single term with Mitchell Shire from 2005 to 2008 and also claimed the shire had repeatedly ignored his calls while he was a councillor for more to be done to address fire prevention.
“I told the shire on many occasions that this was one of the world’s most highly bushfire-prone areas,” Mr Hammond told The North Central Review yesterday.
“They took no notice.
“They could have done fuel reduction burns; it was critical and none were done.”
Legal representatives for Mitchell Shire Council also attended yesterday’s hearing.
Mitchell Shire Mayor Graeme Coppel said Mr Hammond’s claims were “puzzling” and he was “irritated” that the tribunal hearing would cost ratepayers.
In his complaint to VCAT Mr Hammond states that “instead of killing bushfires, some councillors and the CEO clearly decided to kill me instead.”
He said he is seeking financial compensation of an undisclosed amount to pay for the ongoing medical treatment for a rare condition he has suffered since 2007.
“What I want is some money to enable me to survive,” he said.
He said the medication he needs for the illness is “extremely expensive”.
Mr Hammond, who also served as a councillor with the now-defunct Kilmore Shire Council, also accused Mitchell of publishing “fictitious information” about him in meeting minutes on its website following a heated council meeting in February 2007.
He said the minutes had stated that he had used “threatening behaviour” during the meeting.
Cr Coppel said Mr Hammond’s claims had no merit and that the exercise was an unnecessary cost to ratepayers.
“I disagree with his claims; I think the nature of the claim is light,” he said.
Cr Coppel said he had instructed Mitchell Shire Council CEO David Keenan to “aggressively claim all legal costs whatsoever” if Mr Hammond loses the case.
He estimated that the shire would spend upwards of $10,000 to defend itself.
“I am irritated that community funds have to be spent to defend this.
“Imagine what that money could have done for one of our towns,” he said.
An official hearing has been scheduled for later this year.
