MITCHELL Shire Council has adopted a new procedure to ensure compliance with the Code of Practice for Timber Production 2007.
The sensitive issue for many landowners in proximity to Midway plantations was made public in a last minute decision at Tuesday’s council meeting.
The procedure was adopted after Council sought legal advice on an alleged wilful breach of the Code of Practice for Timber Production 2007 in Kilmore East last year, to which council found there was “no evidence based on the audit report.”
Kilmore East property owners and organic beef farmers, Leigh and Catherine Speechley, maintain that their drinking water was contaminated with simazine after a Midway aerial spray in April 2010.
“Aerial spraying Midway’s plantation (in Kilmore East) is absolutely guaranteed to pollute our property every time Midway conducts these activities,” Ms Speechley said.
“A large proportion of the plantation land slopes down towards our main dam so when it rains all that run-off flows on to our property and into our main dam and from there flows into the public water ways of Sunday Creek and the Goulbourn River.”
Ms Speechley said two independent test results, taken four and six months after the aerial spraying, showed excessive levels and toxicity of simazine and other chemicals used on the plantation.
“Spray drift from helicopters impacted on Leigh personally when diverting our pipes from our roof collecting drinking water,” Ms Speechley said.
“Our air and our water are polluted; this council have not delivered on their responsibility to this community.”
Kilmore Shire Council issued a planning permit for the establishment and operation of a softwood plantation in Saunders Road, Kilmore East, in 1986.
The permit was granted under the condition that no aerial spraying of the plantation was permitted.
Acting CEO Rob McVernon responded to the Speechleys stating that council found that the 1986 permit to the current development no longer applies as the former plantation was destroyed by fire in 2009.
The current plantation has not been established under the 1986 permit as it is a hardwood plantation.
“Aerial spraying is not a prohibited activity under either the code or the planning scheme,” Mr McVernon said.
As the “responsible authority,” council has requested a chemical application plan and appropriate notification for each six month period.
This applies for all Midway plantations adjoining residential development and any sensitive use within 200 metres.
Council will refer each chemical application plan to the Department of Primary Industries for assessment prior to any aerial spraying in sensitive areas.
Council is currently considering developing an aerial spraying in timber plantations fact sheet with the DPI.
