BRIAN Woodhouse-Young has been preparing for the coming fire season but is in a deadlock with VicRoads, who will not give him the green light to clear fallen tress on his property.
Surrounding Mr Woodhouse-Young’s Kilmore property, on the Northern Highway, is a build up of waste from the cypress trees that border his property, but are on VicRoads’ land.
The trees are located five metres from his fence line along his property for approximately 120 metres.
Mr Woodhouse-Young has been fighting for approval to remove the fire hazard since moving to the area 15 months ago.
"Having moved from the Blue Mountains we’re used to bushfire conditions. We began chasing VicRoads on the issue a couple of weeks after we moved in and are still chasing," he said.
In August the State Government introduced the 10/30 Right, new regulations regarding clearing on properties.
Part of the regulation states that "under the changes, landowners are also allowed to clear all vegetation, including trees, for a combined maximum width of four metres either side of the property boundary fence provided they have the permission of the neighbouring landowner."
On September 7 this year Mr Woodhouse-Young sent a request to VicRoads asking for permission to clear from his front gate, south along the boundary fence as far as his orchard to a width of four metres.
With the cypress pines five metres from his boundary fence he was seeking permission to remove the branches that overhung within four metres of his boundary fence, and he is still waiting for an answer.
Representatives from Mitchell Shire Council, the Department of Sustainability and Environment and Kilmore’s CFA Captain Greg Murphy have all been out to inspect the site and agree that the trees need to be cut back for fire safety.
VicRoads sent a contractor out in September but they mistakenly took away a fallen gum tree without inspecting the Cypress pines.
Mr Woodhouse-Young has trimmed the branches that overhung his property, which has created more waste on and surrounding his property.
VicRoads workers trimmed the trees within a metre of the markers that line the Northern Highway to ensure the reflector pegs could be seen, but left the trimmings underneath the trees, creating more fire fuel.
"People drive past on the Northern Highway, it will just take one cigarette butt out the window and the trees would be alight," Mr Woodhouse-Young said.
"My wife was terrified during the bushfires, with the fires north of Heathcote and the fire at Kilmore East, she felt surrounded.
"She was already packed to evacuate, but found when she tried to contact friends at places like Strath Creek to see if they needed assistance with the fire approaching, the fire had already been through the area and it was yet to be reported.
"Now VicRoads is going to make us go through the whole thing again, totally unprotected or prepared for fire from the roadside," he said.
Local MP Fran Bailey also weighed in on the issue, contacting VicRoads on behalf of Mr Woodhouse-Young in June, as well as Environmental Services Manager for Mitchell Shire Council, Joe Watkins.
The last correspondence from VicRoads was on October 16.
Jeff Blackie, Team Leader Maintenance for VicRoads, said they were "still trying to get advice from our Head Office regarding the process we are meant to follow, including consultation with other authorities, etc, as previously discussed. Nothing forthcoming as yet."
The North Central Review contacted Mr Blackie on the issue but he did not respond in time for publication.
